ShareFuse Terms of Service

1. Acceptance of Terms

By creating an account, accessing, or using the services provided by ShareFuse ("ShareFuse," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not use our Service.

These Terms constitute a legally binding agreement between you ("Customer," "User," or "you") and ShareFuse Ltd.

2. Definitions

  • "Service" refers to the ShareFuse software application, website (www.sharefuse.app), and related services that act as a distribution tool allowing users to manage, schedule, and publish content to Supported Platforms.
  • "Supported Platforms" means third-party social media networks (e.g., YouTube, TikTok, Instagram, Facebook, X/Twitter) that ShareFuse integrates with.
  • "Content" means any text, images, videos, audio, or other materials uploaded, scheduled, or transmitted by you through the Service.

3. Account Registration & Eligibility

3.1 Age Requirement

You must be at least 13 years old to use the Service. If you are accessing the Service on behalf of a business or entity, you represent that you have the authority to bind that entity to these Terms.

3.2 Account Security

You are responsible for maintaining the confidentiality of your login credentials. You are strictly prohibited from sharing your account credentials with others. "One seat" is for one individual user only.

3.3 Accurate Information

You agree to provide accurate, current, and complete information during registration and to keep such information updated.

4. Subscription, Billing, and Cancellation

4.1 Subscription Plans

We offer Monthly and Annual subscription plans. Fees are billed in advance.

4.2 No Free Trials

ShareFuse does not offer free trials. All access to the Service requires a valid paid subscription.

4.3 Refunds

All payments are non-refundable. Exceptions are made solely at our discretion in the event of a verified technical error originating from ShareFuse that prevents you from using the Service (e.g., a double charge or persistent service failure not caused by third parties).

4.4 Price Changes

We reserve the right to change our pricing. We will provide at least 30 days' notice before any price increase takes effect.

4.5 Cancellation

You may cancel your subscription at any time via your account dashboard. Upon cancellation, the service will cease at the end of the current billing cycle.

5. Use of the Service

5.1 Purpose

ShareFuse is a distribution tool. You acknowledge that we act as a passive conduit for your online distribution and publication of Content. The user uploads content to ShareFuse and ShareFuse posts to the desired platforms that the user has pre-logged into.

5.2 Prohibited Conduct

You agree not to use the Service to:

  • Upload or distribute content that is illegal, harmful, threatening, abusive, defamatory, or violates any third-party rights.
  • Distribute spam or engage in phishing.
  • Reverse engineer, decompile, or attempt to extract the source code of the Service.
  • Resell, lease, or sublicense the Service to any third party.

6. Intellectual Property & Content Ownership

6.1 Your Content

You retain all ownership rights to the Content you upload to ShareFuse.

6.2 License to ShareFuse

By uploading Content, you grant ShareFuse a worldwide, non-exclusive, royalty-free license to use, reproduce, display, and distribute your Content solely as necessary to provide the Service (i.e., to post your content to the platforms you select).

6.3 Our IP

ShareFuse retains all rights, title, and interest in the Service, including its software, code, design, trademarks, and logos.

7. Third-Party Platforms & API Reliance

7.1 Dependency

Our Service relies on the availability and functionality of APIs provided by Supported Platforms (e.g., YouTube, TikTok, Meta).

7.2 No Liability for Third Parties

ShareFuse is not liable for any issues arising from these third parties, including but not limited to:

  • API downtime or changes that break functionality.
  • Suspension, banning, or restriction of your accounts on Supported Platforms.
  • Removal of your content by Supported Platforms.

7.3 Compliance

You agree to comply with the Terms of Service and Community Guidelines of all Supported Platforms you interact with via ShareFuse (e.g., YouTube Terms of Service, Instagram Terms of Use).

8. Disclaimers and Limitation of Liability

8.1 "As Is" Basis

The Service is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express or implied.

8.2 Liability Cap

To the maximum extent permitted by applicable law, ShareFuse's total cumulative liability to you for any claims arising out of or relating to these Terms or your use of the Service shall not exceed $100 AUD.

8.3 Exclusion of Damages

ShareFuse shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, use, or goodwill.

9. Indemnification

You agree to indemnify, defend, and hold harmless ShareFuse, its officers, directors, and employees from any claims, liabilities, damages, losses, and expenses (including legal fees) arising out of or in any way connected with:

  • Your access to or use of the Service.
  • Your violation of these Terms.
  • Your Content (including claims of copyright infringement or defamation).
  • Your violation of any third-party right or Supported Platform policy.

10. Governing Law and Dispute Resolution

10.1 Jurisdiction

These Terms are governed by the laws of the State of Victoria, Australia, without regard to its conflict of laws principles.

10.2 Venue

You agree to submit to the exclusive jurisdiction of the courts located in Victoria, Australia, for the resolution of any disputes.

11. General Provisions

11.1 Updates

We may update these Terms from time to time. The "Last Revised" date at the top will indicate the latest version. Your continued use of the Service constitutes acceptance of the new Terms.
